      <\/span><\/span><\/span><\/b>Part One: Corrective vs. Punitive Measures<\/span><\/b><\/span><\/span><\/u><\/i><\/p>\n

Analyse the following scenarios and explain which one calls for
\ncorrective measures or for punitive measures by the Erehwon EDRS and why. Some
\nof them might call for a mixture of the two. In answering the question
\nillustrate what information you might you need to know to make your decision.<\/span><\/i><\/p>\n

 <\/span><\/p>\n

1)    
\n<\/span><\/span><\/span>Six months before the election, the Erehwon parliament passes a law
\nforbidding politically inspired protests. Domestic and international legal
\nscholars widely agree that this law violates the Erehwonian Constitution and
\nArticle 21 of the International Covenant on Civil and Political Rights, which
\nErehwon ratified in 1983. Two political parties file a complaint with the
\nErehwon Supreme Court, which is empowered to interpret and modify Erehwonian
\nlaws if they are inconsistent with the Constitution or international
\nobligations.<\/span><\/p>\n

 <\/span><\/p>\n

2)    
\n<\/span><\/span><\/span>The Erehwon Widget Manufacturing Concern, Ltd., a private corporation,
\nhas told its 30,000 employees that it will pay 5 Hwonies (In 2016, 5 Hwonies =
\n1 Euro) to those who can demonstrate (by taking a picture of their marked
\nballot) that they voted for the Erehwon People\u2019s Party (EPP). It is not illegal
\nin Erehwon to take a picture of one\u2019s own marked ballot inside a polling booth.
\nIt is a crime to pay money to individuals for the purpose of inducing them to
\nvote for a particular party or candidate, or to not vote on election day.<\/span><\/p>\n

\n<\/span><\/span><\/span>An electoral official at a polling station in Latipac City, the
\ncapital of Erehwon, has failed to follow procedures and allowed voters to mark
\ntheir ballots on a table in the middle of the room, not in the private voting
\nbooths.<\/span><\/p>\n

\n<\/span><\/span><\/span>The police chief of Latipac City has denied the EPP a permit to
\nconduct a campaign rally during the campaign period, even though the EPP
\ncomplied with all notice requirements and other application rules. The EPP has
\nfiled a complaint against the chief for taking this action. <\/span><\/p>\n

5)    
\n<\/span><\/span><\/span>An Erehwonian citizen voted twice on the same day in the same
\nelection, once in Latipac City where she currently resides, and once in
\nDeuxville, where she was born and her parents still live. It is a crime to vote
\nmore than once in an election. The citizen\u2019s name appeared on the voter roll in
\nboth constituencies.<\/span><\/p>\n

6) The Erehwon Ministry of
\nTrucks, Buses, and Very Big Cars (\u201cthe MoTBVBC\u201d) is responsible for ensuring
\nthat all ballots and other supplies are delivered to all polling centers and
\nstations by the day before the election. Because of very poor weather in snowy,
\nmountainous northern Erehwon, about 10% of the supplies did not arrive to
\npolling sites in that region until noon on election day. <\/span><\/p>\n

\n<\/span><\/span><\/span>Erehwon Law on Elections, Art. 45: Any polling center or polling
\nstation official who fails to perform in a satisfactory manner shall be
\nreprimanded.<\/span><\/p>\n

\n<\/span><\/span><\/span>Erehwon Penal Code, Art. 87(b): Any person found to be using intimidation,
\nforce, or the threat of force to induce another person to vote for a particular
\ncandidate or party, or to prevent another person from voting in an election,
\nshall be punished with a fine between 50,000 and 200,000 Hwonies and
\nimprisonment.<\/span><\/p>\n

\n<\/span><\/span><\/span>Erehwon Electoral Regulation Number 19, Art. 5: Any candidate who
\nmakesa public statement during the official campaign period that insults the
\ndignity of any other candidate shall be assessed a fine of up to 5,000 Hwonies
\nfor each such public statement.<\/span><\/p>\n

4) Erehwon Law on Political
\nParties, Art. 6(e)(1): The Erehwon People\u2019s Party (EPP) and the Party for the
\nErehwonian Revival (PER) shall be prohibited from advertising over all
\nbroadcast media during the 48-hour period prior to the opening of polls on
\nelection day.<\/a><\/span><\/p>\n

Erehwon has grown dissatisfied with its electoral legal framework and
\nits current EDRS institutions and has invited you to visit and consult with key
\nelectoral stakeholders on developing a new EDRS to address electoral
\nchallenges. Following two interesting but busy weeks in the country, travelling
\nto all parts and speaking with a range of electoral officials, lawmakers,
\njudges, law enforcement officials, party representatives, and others, you have
\nmade the following preliminary conclusions about Erehwon\u2019s political and legal
\nenvironment:<\/span><\/i><\/p>\n

 <\/span><\/p>\n

1)    
\n<\/span><\/span><\/span>Erehwon is currently polarized politically. Although there are 9
\npolitical parties in the country, all of which operate freely, the country\u2019s Parliament
\nhas been dominated for the last 30 years by two parties, the EPP and the PER.
\nThere has been no violence between or instigated by either party, but the
\nrhetoric and the attacks by one party against the other have grown stronger and
\nnastier in recent years. Currently, a coalition led by PER has a narrow
\nmajority in Parliament. EPP, the second largest party, is currently in
\nopposition.<\/span><\/p>\n

2)    
\n<\/span><\/span><\/span>Erehwon\u2019s regular court system, which hears all criminal and civil
\nmatters in the country, is very well-respected and considered by all to be
\nindependent. However, they face a large backlog of cases, resulting in lengthy
