The New York Times has cited &nbsp;&nbsp;in a recent article that as per the National<br \/>\nJudicial Data Grid over 50 million legal cases are pending across India which<br \/>\nhas doubled over the past two decades.<a href=\"#_ftn1\" name=\"_ftnref1\" title=\"\"><span class=\"MsoFootnoteReference\"><!--[if !supportFootnotes]--><span class=\"MsoFootnoteReference\"><span style=\"font-size: 12pt; line-height: 115%;\">[1]<\/span><\/span><!--[endif]--><\/span><\/a> It<br \/>\nwas also speculated in the article that it might take more than 300 years if<br \/>\nthe disposal of cases take place at the current rate.<a href=\"#_ftn2\" name=\"_ftnref2\" title=\"\"><span class=\"MsoFootnoteReference\"><!--[if !supportFootnotes]--><span class=\"MsoFootnoteReference\"><span style=\"font-size: 12pt; line-height: 115%;\">[2]<\/span><\/span><!--[endif]--><\/span><\/a> With<br \/>\nmillions of cases pending in courts across the country, the judicial process<br \/>\noften becomes slow, inefficient, and inaccessible, particularly for<br \/>\nmarginalized communities. This backlog not only delays justice but also<br \/>\nundermines the public\u2019s trust in the legal system. <o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;text-justify:inter-ideograph;\nline-height:150%\"><span style=\"font-family:&quot;Times New Roman&quot;,serif\">The Law<br \/>\nCommission of India has consistently pointed out that the cause of judicial<br \/>\ndelays is not a lack of clear procedural laws, but rather the flawed<br \/>\nimplementation or even outright disregard of these procedures <a href=\"#_ftn3\" name=\"_ftnref3\" title=\"\"><span class=\"MsoFootnoteReference\"><!--[if !supportFootnotes]--><span class=\"MsoFootnoteReference\"><span style=\"font-size: 12pt; line-height: 115%;\">[3]<\/span><\/span><!--[endif]--><\/span><\/a>[9].<br \/>\nThe 14<sup>th<\/sup> Report of the Law Commission of India emphasized that<br \/>\ndelays in the judicial system do not arise due to deficiencies in legislative<br \/>\nprocedures but rather result from the failure to adhere to many critical<br \/>\nprovisions, especially those intended to expedite proceedings. Given the vast<br \/>\nnumber of pending cases,<a href=\"#_ftn4\" name=\"_ftnref4\" title=\"\"><span class=\"MsoFootnoteReference\"><!--[if !supportFootnotes]--><span class=\"MsoFootnoteReference\"><span style=\"font-size: 12pt; line-height: 115%;\">[4]<\/span><\/span><!--[endif]--><\/span><\/a><br \/>\n[10] managing and administratively overseeing judicial institutions through<br \/>\nmanual processes has become exceptionally challenging. The Supreme Court has<br \/>\nstressed the need to address this issue, emphasizing that an independent and<br \/>\nefficient judicial system is a fundamental element of the Constitution. It is<br \/>\nthe constitutional duty to reduce case backlogs and enhance case disposal rates<br \/>\n<a href=\"#_ftn5\" name=\"_ftnref5\" title=\"\"><span class=\"MsoFootnoteReference\"><!--[if !supportFootnotes]--><span class=\"MsoFootnoteReference\"><span style=\"font-size: 12pt; line-height: 115%;\">[5]<\/span><\/span><!--[endif]--><\/span><\/a>[11].<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;text-justify:inter-ideograph;\nline-height:150%\"><span style=\"font-family:&quot;Times New Roman&quot;,serif\">As per the National<br \/>\nJudicial Data Grid, in2024, the total number of pending cases of all types and<br \/>\nat all levels have reached an alarming ceiling of 5.1 million or 5.1 crores, including<br \/>\nover 180,000 court cases pending for more than 30 years in district and high<br \/>\ncourts.<a href=\"#_ftn6\" name=\"_ftnref6\" title=\"\"><span class=\"MsoFootnoteReference\"><!--[if !supportFootnotes]--><span class=\"MsoFootnoteReference\"><span style=\"font-size: 12pt; line-height: 115%;\">[6]<\/span><\/span><!--[endif]--><\/span><\/a> Not<br \/>\nonly that, the report also shows that 4.5 crore out of 5.1 crore cases, which<br \/>\naccounts for more than 87% cases are pending in district courts presently.<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;text-justify:inter-ideograph;\nline-height:150%\"><span style=\"font-family:&quot;Times New Roman&quot;,serif\">According<br \/>\nto a 2018 Niti Aayog strategy paper, at the then-prevailing rate of disposal of<br \/>\ncases in the courts, it would take more than 324 years to clear the<br \/>\nbacklog.[10]<o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;text-justify:inter-ideograph;\nline-height:150%\"><span style=\"font-family:&quot;Times New Roman&quot;,serif\">While the<br \/>\nhumongous burden on the Indian judiciary is becoming more noxious day by day,<br \/>\nthe public\u2019s trust in the efficient delivery of justice is also fraying at the<br \/>\nedges. Alternate Dispute Resolution (shortly called as ADR) mechanisms<br \/>\nis often marketed as an effective means to address disputes outside the traditional<br \/>\ncourt system have become a prominent option in the legal dispute resolution arena.<br \/>\nAlternative Dispute Resolution (ADR for short) as the name suggest, is an<br \/>\nalternative to formal litigation that involves traditional judicial system. Lok<br \/>\nAdalats are one such mode of dispute resolution that aims for settling disputes<br \/>\nefficiently. In the recent years Lok Adalats have emerged as a popular means of<br \/>\nsettling dispute or one can say bringing comprise between the parties to the<br \/>\ndispute. <o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;text-justify:inter-ideograph;\nline-height:150%\"><span style=\"font-family:&quot;Times New Roman&quot;,serif\">STATEMENT<br \/>\nOF PROBLEM <o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify;text-justify:inter-ideograph;\nline-height:150%\"><span style=\"font-family:&quot;Times New Roman&quot;,serif\">\u201cJustice<br \/>\nhurried is justice buried\u201d is another powerful phrase that captures the dangers<br \/>\nof rushing legal proceedings.
