Still, several<br \/>\nissues should be tackled. Since the legal institution of administrative<br \/>\nprocedures is relatively new in the legal system of Uzbekistan, almost no<br \/>\nresearch in this area has been conducted by national scholars. Few scholars<br \/>\nexpressed their views only on the terms \u201cadministrative act\u201d<a style=\"cursor: auto;\"><span style=\"cursor: auto; color: inherit;\"><span style=\"font-size: 10.5pt; line-height: 116%; cursor: auto; color: inherit;\">[1]<\/span><\/span><\/a> and \u201cadministrative<br \/>\ndocument\u201d<a style=\"cursor: auto;\"><span style=\"cursor: auto; color: inherit;\"><span style=\"cursor: auto; color: inherit;\"><span style=\"cursor: auto; color: inherit;\"><span style=\"font-size: 10.5pt; line-height: 116%; cursor: auto; color: inherit;\">[2]<\/span><\/span><\/span><\/span><\/a>,<br \/>\nyet many issues existing as a barrier in the development of administrative<br \/>\nprocedures still remain untouched by the scholars.<\/span><\/p>\n<p style=\"line-height: 200%; cursor: auto; color: inherit;\"><span style=\"font-size: 10.5pt; line-height: 200%; cursor: auto; color: inherit;\">To unify the application of the Law<br \/>\n\u201c<i style=\"cursor: auto; color: inherit;\">On Administrative Procedures<\/i>\u201d, to ensure the equality of the<br \/>\nenforcement of the law in all parts of Uzbekistan, entrepreneurs and other<br \/>\nbusiness entities appeal on the unlawful actions and neglect behavior of government<br \/>\nauthorities, and decisions of administrative courts because of<br \/>\nmisinterpretation of the law by the courts, a legislative intervention is<br \/>\nrequired. These authorities are vested with the capacity to grant permissions,<br \/>\nlicenses, certificate and other types of permissive documents to start, change,<br \/>\nand\/or end the business. Besides the need for the unification of administrative<br \/>\nprocedures, there are several areas of the law, specifically, where challenges<br \/>\narise that could hinder the full enforcement of the law. First, the law is<br \/>\ndetailed and comprehensive, necessary for thorough regulation. However, this<br \/>\ncomplexity could pose challenges for individuals and entities to fully<br \/>\nunderstand and comply with the procedures. In this regard, ensuring<br \/>\naccessibility and clear communication of the procedures to all stakeholders is<br \/>\ncrucial. Also, article 21 emphasizes interdepartmental interaction, which is<br \/>\nessential for effective administrative procedures. However, coordination<br \/>\nbetween different departments and agencies can be challenging due to varying<br \/>\nprotocols, priorities, and bureaucratic hurdles. Article 12 highlights the<br \/>\ninadmissibility of bureaucratic formalism: <\/span><\/p>\n<p style=\"margin-left: 0.5in; line-height: normal; cursor: auto; color: inherit;\"><span style=\"font-size: 10.5pt; cursor: auto; color: inherit;\">\u201cAdministrative bodies are prohibited from burdening<br \/>\ninterested persons with duties, denying them rights or restricting their rights<br \/>\nin any other way for the sole purpose of complying with formal rules and<br \/>\nrequirements\u201d.<a style=\"cursor: auto;\"><span style=\"cursor: auto; color: inherit;\"><span style=\"cursor: auto; color: inherit;\"><span style=\"cursor: auto; color: inherit;\"><span style=\"font-size: 10.5pt; line-height: 116%; cursor: auto; color: inherit;\">[3]<\/span><\/span><\/span><\/span><\/a> <\/span><\/p>\n<p style=\"line-height: 200%; cursor: auto; color: inherit;\"><span style=\"font-size: 10.5pt; line-height: 200%; cursor: auto; color: inherit;\">In practice, however, bureaucratic<br \/>\ntendencies can be deeply ingrained, leading to unnecessary delays and obstacles<br \/>\nin administrative procedures. While Article 14 promotes the \u201cone-stop-shop\u201d<br \/>\nprinciple for efficiency stating that <\/span><\/p>\n<p style=\"margin-left: 0.5in; line-height: normal; cursor: auto; color: inherit;\"><span style=\"font-size: 10.5pt; cursor: auto; color: inherit;\">\u201cIn cases where the administrative body for the<br \/>\nimplementation of the administrative procedure requires the receipt of<br \/>\ndocuments and information from other administrative and other bodies,<br \/>\nadministrative proceedings are carried out according to the \u201cone-stop shop\u201d<br \/>\nprinciple, in which the administrative body receives the necessary documents<br \/>\nand information on its own, without the participation of interested parties<br \/>\nthrough interdepartmental interaction, except as provided by law\u201d. <\/span><\/p>\n<p style=\"line-height: 200%; cursor: auto; color: inherit;\"><span style=\"font-size: 10.5pt; line-height: 200%; cursor: auto; color: inherit;\">However, the actual implementation<br \/>\nof this principle can be challenging due to the need for significant<br \/>\ncoordination and integration of various administrative services. <\/span><\/p>\n<p style=\"line-height: 200%; cursor: auto; color: inherit;\"><span style=\"font-size: 10.5pt; line-height: 200%; cursor: auto; color: inherit;\">Despite the progressive nature of<br \/>\nthe Law on Administrative Procedures in Uzbekistan, its implementation stays<br \/>\nlargely theoretical, with old administrative practices persisting in practice.<br \/>\nThis discrepancy between the legal framework and its practical application has<br \/>\nled to a lack of judicial enforcement, low awareness and compliance among<br \/>\nentrepreneurs and administrative bodies, and continued occurrence of unlawful<br \/>\nadministrative acts. As a result, there is a significant negative impact on<br \/>\nbusiness confidence, investment intentions, and job creation, undermining the<br \/>\nstate&#8217;s policy goals of improving the business environment and investment<br \/>\nattractiveness. Additionally, issues such as disproportionate administrative<br \/>\nmeasures, questionable legitimacy of control measures, and inadequate<br \/>\nimplementation of the principle of proportionality further exacerbate the<br \/>\nproblem. These challenges highlight the need for a unified legal system in the<br \/>\nfield of administrative procedures in Uzbekistan to ensure effective governance,<br \/>\ntransparency, and the protection of citizens\u2019 and businesses\u2019 rights.<\/span><\/p>\n<p style=\"line-height: 200%; cursor: auto; color: inherit;\"><span style=\"font-size: 10.5pt; line-height: 200%; cursor: auto; color: inherit;\">The most disturbing problem in the field<br \/>\nof administrative procedures in Uzbekistan is the significant gap between the<br \/>\nlegislative framework and its practical implementation. This issue primarily<br \/>\nstems from the resistance of administrative bodies to adopting new practices<br \/>\nmandated by the law, combined with insufficient training for legal staff. As a<br \/>\nresult, many administrative bodies continue to rely on outdated procedures,<br \/>\nwhich leads to a lack of judicial enforcement and a persistent disconnection<br \/>\nbetween the legislative intentions and actual administrative practices. These<br \/>\nchallenges significantly hinder the effectiveness of the Law on Administrative<br \/>\nProcedures, undermining its intended benefits of ensuring fairness,<br \/>\ntransparency, and efficient governance.<\/span><\/p>\n<p style=\"line-height: 200%; cursor: auto; color: inherit;\"><b style=\"cursor: auto; color: inherit;\"><span style=\"font-size: 10.5pt; line-height: 200%; cursor: auto; color: inherit;\">Research question and thesis statement<\/span><\/b><\/p>\n<p style=\"line-height: 200%; cursor: auto; color: inherit;\"><span style=\"font-size: 10.5pt; line-height: 200%; cursor: auto; color: inherit;\">Numerous legislative efforts and<br \/>\nreforms have been undertaken in Uzbekistan to establish a unified legal system<br \/>\nof administrative procedures aimed at improving efficiency, transparency, and<br \/>\nlegal compliance in governance. Despite these efforts, practical challenges<br \/>\nsuch as inconsistent application, bureaucratic resistance, and limited<br \/>\nenforcement continue to undermine the effectiveness of these reforms. This<br \/>\ndiscrepancy between the legislative intent and its real-world application<br \/>\npresents a critical area for analysis and improvement.
