While the<br \/>\nConstitution establishes municipalities for the whole of the territory of South<br \/>\nAfrica, it constitutes government as national, provincial, and local spheres of<br \/>\ngovernment which are distinctive, interdependent, and interrelated.<\/span><\/p>\n<p style=\"cursor: auto; color: inherit;\"><span style=\"cursor: auto; color: inherit;\">&nbsp;<\/span><\/p>\n<p style=\"cursor: auto; color: inherit;\"><span style=\"cursor: auto; color: inherit;\">The convergence of these provisions in how the country is<br \/>\ngoverned yields an intergovernmental relations intensive government and<br \/>\nrequires state organs to operate within the Chapter Three cooperative<br \/>\ngovernment principles.<\/span><\/p>\n<p style=\"cursor: auto; color: inherit;\"><span style=\"font-size: 11.5pt; line-height: 150%; cursor: auto; color: inherit;\">&nbsp;<\/span><\/p>\n<p style=\"cursor: auto; color: inherit;\"><span style=\"cursor: auto; color: inherit;\">The municipal elections resulted in hung councils. The sum<br \/>\nimpact of these hung councils when viewed from the perspective of hung<br \/>\nmunicipal budgets, is that a substantial portion of municipal budget spending<br \/>\nwill be subject to continuous coalition government negotiations and<br \/>\nvulnerabilities.<\/span><\/p>\n<p style=\"cursor: auto; color: inherit;\"><span style=\"cursor: auto; color: inherit;\">&nbsp;<\/span><\/p>\n<p style=\"cursor: auto; color: inherit;\"><span style=\"cursor: auto; color: inherit;\">The capability of the national and provincial state to impact<br \/>\nthe local state will enter a phase where it will be mediated <b style=\"cursor: auto; color: inherit;\">through policy<br \/>\nfilters<\/b> that advance one political hegemony or persuasion or the other,<br \/>\nsave for where the provincial or national governing hegemony is of the same<br \/>\npolitical party.<\/span><\/p>\n<p style=\"cursor: auto; color: inherit;\"><span style=\"cursor: auto; color: inherit;\">&nbsp;<\/span><\/p>\n<p style=\"cursor: auto; color: inherit;\"><span style=\"cursor: auto; color: inherit;\">The impact on policy intents, how these policies are<br \/>\nspatially prioritised, whether the the success in the delivery of intents is<br \/>\nrecognised, and the extent to which government will use such progress as party<br \/>\npolitical victories, will be both unprecedented and defining in how coalition<br \/>\ngovernment cooperation matures in South Africa.<\/span><\/p>\n<p style=\"cursor: auto; color: inherit;\"><span style=\"cursor: auto; color: inherit;\">&nbsp;<\/span><\/p>\n<p style=\"cursor: auto; color: inherit;\"><span style=\"cursor: auto; color: inherit;\">The rise of genuine opposition politics in South Africa has<br \/>\nfirmly established a context where the Constitution&#8217;s schedule 4 and 5<br \/>\nfunctional areas of concurrent or exclusive legislative or otherwise competence<br \/>\nwill henceforth be expected to co- exist with voter power instead of being<br \/>\nfundamentally utilised to advance a party&#8217;s prerogative that are not voter<br \/>\nsanctioned. As the new democratic order assumes its government &#8216;of&#8217;,&#8217; by&#8217;, and<br \/>\n&#8216;for&#8217; the people, a context of competing for approval to govern by voters will<br \/>\nforce innovation in how a centralized national government will relate to the<br \/>\nlocal sphere of government.<\/span><\/p>\n<p style=\"cursor: auto; color: inherit;\"><span style=\"cursor: auto; color: inherit;\">&nbsp;<\/span><\/p>\n<p style=\"cursor: auto; color: inherit;\"><span style=\"cursor: auto; color: inherit;\">The way intergovernmental relations (IGR) were handled<br \/>\npreviously left local government to not only assume a life of its own but<br \/>\nexpose policy ambiguities and uncertainties that put the sensitive issues of<br \/>\nfiscal reform and federalism back on the agenda. The &#8216;family-members-only&#8217; IGR<br \/>\nsystem and practice apparent in the uncharacteristic application of section 100<br \/>\nand 139 intervention mechanisms liquidated national government&#8217;s capability to<br \/>\nnegotiate with other spheres as equal before the law organs of state envisaged<br \/>\nin the chapter 3 cooperative government principles.<\/span><\/p>\n<p style=\"cursor: auto; color: inherit;\"><span style=\"cursor: auto; color: inherit;\">&nbsp;<\/span><\/p>\n<p style=\"cursor: auto; color: inherit;\"><span style=\"cursor: auto; color: inherit;\">The reach of the power of the Constitution, its rule of law<br \/>\nbasis, and the spirit of the cooperative government principles was for a while<br \/>\nlimited by the unfortunate &#8216;family-members-only&#8217; approach to intergovernmental<br \/>\nrelations.
