For the final paper I want you to cover something related to administrative law, in so much as to
how we have covered it. To narrow it down I want you to start with a policy area, healthcare,
environment, local government, whatever. Then you will narrow it down to a particular policy or
set (small, related set) of policies within that larger policy area. From there you will need to see
how the interaction with the courts has changed how that policy is implemented.
This is not as simple as taking a case and writing about it. We are not lawyers, so the case is not
the central part of our consideration, the effects of the case are. Also, as you are finding out,
cases build on and “talk” to each other, so you will probably need to discuss much more than one
case in this paper.
The paper should be constructed similar to below:
Issue at hand
o What is the policy you are writing about, where did it come from, what was the
reason for it, what was its intent?
o What agency or administrative organization is involved
o What principle of law is the agency’s action based on?
Administrative law
o What spurred the challenge to the role the agency or organization played in this
policy?
o What did the court(s) say. Be sure to engage in the decision-making by the lower
courts as much as possible to understand what the precedent they are working
with (as you should describe the status quo).
How did the agency respond?
o Was the agency’s action upheld?
o What changes would be made to the policy if the agency’s action was not upheld?
o What does this mean for the policy area going forward?
Please, double space your paper and use a regular 12-point font. Papers are to be 7-10 pages long (not
including cover page and bibliography).
Use either APA style for your bibliography and citations. Incorrectly cited papers, minus ten percent.
Papers without citations but with sources, minus twenty percent. Papers without sources will not be
accepted, period.
As for sources, please do not cite Wikipedia, an encyclopedia, or a dictionary. If you have questions about
the veracity of a source, please contact me and I will let you know whether or not it is acceptable. DO
NOT quote (directly) any text. The exception being unless you are quoting a court case in which the
sentence of what the justice says is crucial.
