Final Paper (5-10 pages) + Infographic
Purpose: To present a polished, comprehensive argument on an issue of great import (available questions below). You should also create an informational graphic that creatively summarizes your paper. You must use Hart’s theory of formal fiduciary responsibility.
The paper should utilize the ideas from at least one of the jurisprudential frameworks from the readings (Natural Law, Modern Legal Positivism, Dworkin, American Legal Realism, Social Theory, Historical/Anthropological Jurisprudence, Theories of Justice, Obedience/Punishment, Critical Legal Theory, and/or Feminist Legal Theory). Your paper should align the ideas from jurisprudence with the problems and solutions to your chosen question. The book and videos are your best friends; use them.
Available Questions:
- When is it justifiable to assist individuals whose ancestors were targeted and marginalized by governmental policies?
- When is it justifiable for current generations to use natural resources for economic profit?
- When is it justifiable for the government/doctors to support/prevent active/passive euthanasia?
For the question in your paper,
- You should locate at least three primary legal materials (e.g., statutes, regulations, local ordinances, precedents) and provide verbatim excerpts – with links to original documents – in an Appendix (after the works cited).
- State the issues involved in your question and those materials.
- Analyze the issues through at least the frameworks of Hart, Dworkin, OWH Jr., Roberto Unger, Wendy Williams, and Katharine Bartlett.
- Identify conflicts and complementarities among these frameworks.
- Propose a reasoned adaptation or synthesis of these theories that best resolves the dispute(s).
Format: The paper should be Times New Roman, 12 pt font, double-spaced, 1″ margins.
Deliverable:
- A 5-10 page final paper, incorporating and fully developing your arguments.
- An informational graphic that creatively reflects the problem and your arguments as filtered through the theory(ies)
- A 1-2 page process reflection, discussing:
- How you chose the question and sources
- How the paper evolved as you wrote it.
- What you learned about law and academic writing.
- How your answer connects to your idea of humanity
