For decades, immigration/illegal immigration has shaped both domestic (internal policy) and foreign (relationship with our neighbors) policy. The topic has a very real “legal” framework governing the process and conditions of immigration and a very real human (heart) concern or “moral” framework for those coming into the country. Legal positivism is the theory that the existence of the law and its content depend on social facts, such as acts of legislation, judicial decisions, and customs, rather than on morality. Others such as Ronald Dworkin distance themselves from separation of law and morality, since constructive interpretation implicates moral judgments in every decision about what the law is. Torbin Spaak (reading assignment) outlines the two demonstrating the superiority of the moral framework in interpretation.
